These Terms of Use (“Terms”) govern access to and use of the PEPTPlus platform (the “Service”), which coordinates compounded prescriptions among licensed healthcare providers, verified 503A/503B compounding pharmacies, and patients. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
PEPTPlus is a marketplace and coordination platform. PEPTPlus does not practice medicine, does not practice pharmacy, and does not compound, dispense, or ship medications. Prescribing is performed by licensed providers, and dispensing and fulfillment are performed by licensed compounding pharmacies. PEPTPlus facilitates routing, communication, record-keeping, and payment coordination between these parties.
2. Eligibility & accounts
- Provider accounts are limited to appropriately licensed healthcare providers and their authorized staff.
- Pharmacy accounts are limited to licensed 503A/503B compounding pharmacies that complete verification.
- You are responsible for maintaining the accuracy of your account information and the confidentiality of your credentials.
- You are responsible for all activity that occurs under your account.
3. Provider responsibilities
Providers are solely responsible for their clinical decisions, including the appropriateness of any prescription, dosing, and instructions. Providers represent that they hold valid licensure in each jurisdiction in which they prescribe and that each prescription complies with applicable law and professional standards.
4. Pharmacy responsibilities
Pharmacies are solely responsible for verifying, compounding, dispensing, labeling, and shipping medications in compliance with applicable federal and state law, including 503A/503B requirements, and for providing accurate compound, pricing, and certificate-of-analysis (COA) information.
5. FDA-eligible compounds only
The Service is intended to list and route only compounds that are eligible to be compounded and prescribed under applicable law. Eligibility may be enforced through platform data controls; however, the parties remain responsible for ensuring legal compliance of each transaction.
6. Patients & medical disclaimer
Patients receive medications dispensed by a licensed pharmacy pursuant to a valid prescription from their provider. The Service does not provide medical advice, diagnosis, or treatment. Patients should direct clinical questions to their prescribing provider or dispensing pharmacy.
7. Payments & fees
Subscription fees, order charges, and any applicable channel fees are described at the point of purchase or in a separate written agreement. Card payments are processed by a third-party payment processor. Except as required by law or expressly stated, fees are non-refundable.
8. Acceptable use
- Do not use the Service for any unlawful purpose or to prescribe or dispense outside your licensure.
- Do not misrepresent identity, licensure, or eligibility.
- Do not attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.
- Do not upload false, misleading, or non-compliant compound or COA information.
9. Privacy & data
Use of the Service is also governed by our Privacy Policy. Protected Health Information is handled under applicable Business Associate Agreements and HIPAA safeguards. During the interim phase, environments may contain synthetic (non-real) data for development and demonstration purposes.
10. Intellectual property
The Service, including its software, design, and content, is owned by PEPTPlus or its licensors and is protected by intellectual-property laws. You receive a limited, revocable, non-exclusive license to use the Service in accordance with these Terms.
11. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. PEPTPlus does not warrant that the Service will be uninterrupted or error-free.
12. Limitation of liability
To the maximum extent permitted by law, PEPTPlus will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any clinical, prescribing, dispensing, or fulfillment decisions made by providers or pharmacies, which are the sole responsibility of those parties.
13. Indemnification
You agree to indemnify and hold PEPTPlus harmless from claims arising out of your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.
14. Termination
We may suspend or terminate access for violations of these Terms, suspected fraud, or legal or regulatory reasons. You may stop using the Service at any time, subject to any continuing record-keeping obligations.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated through the Service or by other reasonable means. Continued use after an update constitutes acceptance of the revised Terms.
